A "Commune" in French is the smallest form of a city. This name is to be linked to the law that created it on november 12th, 1789.

In 2019, France counts 34 968 Communes. In 2015, they were 36 658. You will discover hereafter how they dissappear.

The smallest village in France with a mayor is a "commune" like the biggest city in France (Paris) is also a commune with its mayor. It is an administratve term first.

But to ease the management of global issue regarding growing concentration of population such as transport (goods and people), financement and building of health structures, waste transport management (solid and liquid), etc... the law has regularly created in the past new public administrattive structures to allow Communes to join together their efforts to face an increasing number of issues to be managed at high level to be coherent.

Thus, the Community of Communes of Le Havre today gathers 18 bordering communes. It is nicknamed CODAH for COmunauté D'Agglomérations du Havre.


"Communauté d'Agglomérations" in French administrative language is another intermediate level of Group of Communes that join their forces to manage a larger number of issues. The last level (top) is the "Communauté Urbaine" with the widest possible competences.

 Within this CODAH, rules are enacted to encourage the use of public transport at the expense of private car transport.

The transport of persons by private companies is not exempt from this regulation.

Until the birth of the company UBER, there was globally only one framework to regulate the transport of people in France which applied equally to the smallest companies as to the giants SNCF and Air France. This framework is called LOTI and means « Loi d’Orientation des Transports Intérieurs » which can be more or less translated in Inland Transport Orientation Law. This LOTI defines a LOTI statute which is linked to a LOTI degree / diploma.



We have to make a stop here to explain the whole LOTI meanings.

This LOTI degree (more than 600 hour course) allows its holder to manage the transport of people in vehicle whatever is the number of passengers : from 1 to 50 for a car / a coach, 1000 for a TGV, etc…

Once you have your degree, you have to fulfill 4 conditions as long as you do this job :

  • Honorability : Have and keep a clean record,
  • Financial capacity : a fix amount of money / vehicle always available on your bank account, in respect of each type of vehicle you are working with,
  • Professional abilities : to obtain the LOTI diploma and to train throughout one's career,
  • establishment requirement : for the company, means a physical address

It is not OR but all the 4 conditions all the time.

The holder of this degree is THE person in the company which is legally responsible for the whole transport operations : human management, vehicle repairs, driver workload, etc. The authorities of the State only know him. And only talk to him for that kind of matters. Sometimes he is the boss, sometimes not. But without him, the company cannot run.


Hereafter, you will find VTC. VTC in French means « Véhicule (léger) de Transport avec Chauffeur », which can be translated in Transportation Vehicle (light) with Driver. It is the legal name in France of the final version of the statute for the drivers of UBER.



With the emergence of UBER in the urban transport landscape, the positions acquired by the taxi companies and the LOTI (ie all other forms of passenger transport companies that are not taxi companies at this time) were mistreated. Uncertain conflicts erupted at regular intervals during the years following the arrival of UBER in France between taxis, VTCs (UBER) and LOTI.

Finally, in an attempt to clarify the situtations and statutes, it was eventually removed the ability to LOTI to transport a single person in a vehicle. This activity has become the heart of activity of the VTC which continue to be at war with the taxi companies, their historical activity, mainly in the big cities.

Indeed, this new rule did not remove the fundamental problem between taxis and VTC: VTC was subject to a regulatory framework extremely light compared to that of taxis and even more so, the LOTI. This fundamental problem was in the level of indebtedness of the taxi companies that had purchased a charge to be able to exercise. Roughly speaking, this charge corresponded to the authorization to wait for the customer directly on the public road (administrative authorization exclusively reserved for taxis) and vaguely to a solvency guarantee in case of problem of exercise of the economic activity. Constraints that in no case did not support the VTC.

Finally, after years of legislative wandering about the right solution to put in place, a legal framework similar to that of the LOTI capacity was set up to oversee the activity of the VTC. Overall, the LOTI capacity framework was lightened and adapted to the VTC business base, ie the transport of a single person mainly within a Community of Communes.

This law came into effect on January 1, 2018. Its immediate consequence was a halving of the number of licenses to be a VTC driver. And a relative economic calm but found.
The new fight of the VTC drivers is now within their OWN profession and consists of obtaining reasonable professional conditions and remuneration adapted accordingly.

This file, like many others, perfectly illustrates the sad repetition of social conflicts in general and the consequences of the evolution of techniques on daily work. 

So transport of people inside Le Havre and its CODAH follows the general rule : only a taxi or a VTC can perform this transport operation if you are not willing to use urban transport.

As soon as two people wish to leave CODAH to a place outside the CODAH zone, LOTI companies can also do this work in addition to taxis. As NESTHE SARL / Tours In Normandy is a LOTI company, it cannot offer transport for one sole person.

From 1 January 2019, the ComCom of Le Havre crossed a new Cape by merging with ComCom of Caux Estuaire and one from Criquetot l'Esneval. The total number of municipalities increases from 18 to 54. The Communaute d'Agglomeration du Havre becomes an Urban Community (Communauté Urbaine in French) with the widest possible powers in terms of planning policy for its new territory.
The new Urban Community now has 275,000 inhabitants, 190 km², and 65 kilometers of coastline (about half of the alabaster coast with its 140 kilometers).

Henceforth, we must not say CODAH to be on top but Seine Métropole. On the other hand, the average of the French ignoring the administrative differences between the Community of Communes, Community of Agglomerations and Urban Community, the ComCom term remains, him. This does not facilitate the propagation of concepts.
